1. Introduction

   1. Please read the following terms and conditions carefully. In completing a purchase or checking the terms and conditions box upon purchase at www.emmlife.com.au (The Website) you agree to be bound by these conditions which constitute the agreement between EMMLIFE PTY LTD (The Company) and yourself. In these Terms and Conditions, The Company means our staff, guides, employees, including any facilitators to whom we subcontract duties under these Terms and Conditions.

   2. By attending a provided service, you agree to be bound by these terms. We may update these terms and conditions without prior notice.

   3. These terms and conditions, or anything relating to these terms and conditions fall under the jurisdiction and the laws of Australia.

   4. If any part of these terms is or becomes invalid, that part must be treated for all purposes as severed from these terms.

 

1. Services

   1. We offer our services listed on The Website. We reserve the right to change offered services at any time.

   2. If a service needs to be altered in any way, The Company will let you know as soon as possible.

   3. If a service is rescheduled, The Company will contact you to manage your booking.

 

1. Payments and refunds

   1. For individual services (i.e. Training Therapy, supervision, mentoring) a cancellation/no-show fee of $100 will be issued, if no written cancellation has been received prior to 24 hours to the booking.

   2. For all other services, all monies paid are non-refundable.

   3. If The Company needs to cancel an event, a refund of monies paid towards the specific event, will be issued to you.

   1. If you browse or make a purchase on The Website, you agree to the terms and conditions for the use of The Website.

   2. The Website and all the content provided during any of the offered services may contain intellectual property owned by The Company or third-party sub-contractors, including trademarks, copyrights, and proprietary information.

      1. You may not use, modify, publish, distribute, or in any way exploit in any form, any of The Company or third-party contractors’ intellectual property, in whole or in part, without prior written consent.

1. Conduct

   1. We promote freedom of expression and open communication. But we expect you to avoid offending and disrupting any of the offered services.

   2. We expect you to be respectful and professional to The Company, any staff members, third parties and other participants of the offered service.  

   3. You are to comply with any reasonable requests made by The Company or its sub-contractors to promote the efficiency of the offered service.

   4. We require you to express confidentiality of any information acquired as a result of any interaction on the offered service. You should not disclose any such information to third parties without proper and specific authority unless there is a legal or professional right or duty to disclose. Confidential information acquired as a result of attending any of the offered service should not be used for personal advantage or disclosed to third parties.

   5. If The Company considers that you have breached these terms, we may immediately and without notice terminate your participation in the offered service.

   6. The Company will not disclose to any person information obtained during the offered service without prior consent of the parties involved, unless compelled by law to do so.

   1. To the extent permitted by law, The Company has no liability or responsibility to you for any suffered damages or loss.

   2. Every reasonable effort is made to make sure all the information provided at The Website or any of the offered services is accurate, however, we do not provide any guarantees, and assume no legal liability or responsibility for the accuracy or completeness of the information.

   3. Services and information provided on The Website may contain general information about health and related subjects. This information and any other information provided at any of the offered services is to be considered general of nature and not medical advice, unless attending for individual Training Therapy. Should you need individual medical advice, you should seek consult through your general practitioner.

   5. The Company does not accept any liability for any undertaken extracurricular activities or services that have not been organised by The Company.

   6. The Company is not responsible any damage, loss or injury caused by the participation of offered services provided by the Company or its contractors.

 

1. Exemption clause

   1. The Company will not be liable in the case of any wrongdoing or disruptions caused by third parties.

   2. The Company is not accountable for death or personal injury resulting from negligence.

   3. The Company excludes any liability for loss or damage caused by events. This may include natural disasters, lightning strikes, or other forms of force majeure.

   4. A claim or notice of a breach needs to be logged within 30 days after the attendance of the offered service.

   5. The Company is not accountable for fraud or fraudulent misrepresentation.

   6. These terms and conditions do not modify or exclude any warranties and legal rights under the Australian Competition and Consumer Act and other local laws.
